Bespoke software development or SaaS for a 5–20 person Hunter business

Remote or offshore developers and personal information: what the Privacy Act requires

If you're weighing a developer in India, the questions are whether it's lawful and what you stay accountable for. Codingclave works from Lucknow with no office, staff or ABN in Australia, so these rules apply whenever you share personal information with us. Here is what they require, checked 6 Oct 2026, and how we set a project up to meet them. Some Newcastle studios advertise 'no offshore'; the Privacy Act does not ban overseas contractors, it sets conditions.

  • APP 8.1 and section 16C: reasonable steps, then accountability

    Before personal information goes to an overseas recipient, a covered business must take reasonable steps so the recipient does not breach the Australian Privacy Principles (APP 8.1), and under section 16C it stays accountable for the recipient's acts. The OAIC (chapter 8, para 8.12) treats handing data to an overseas contractor as a disclosure in most circumstances.

  • The $3 million line, and who is covered at any turnover

    Most businesses turning over $3 million or less sit outside the Act, but the OAIC lists health service providers, businesses trading in personal information, Commonwealth contractors and AML/CTF reporting entities as covered at any turnover. Since 1 July 2026 AUSTRAC's reforms reach lawyers, conveyancers, accountants and real estate professionals for certain services, which matters in a city with 2,456 professional-services and 1,893 rental, hiring and real estate businesses (what changed). The ABS top turnover band, '$2m or more' (1,598 City of Newcastle businesses), can't settle the test for you; if you are close, build as though covered.

  • APP 1.4(f)–(g): name overseas disclosure in your privacy policy

    Your policy must say whether personal information is likely to go overseas and, where practicable, to which countries. With a developer in India, update it before real records move.

  • From 10 December 2026: automated decisions

    Where a computer program uses personal information to make, or do something substantially and directly related to making, a decision that could reasonably be expected to significantly affect someone's rights or interests, APPs 1.7–1.9 require the privacy policy to set out the kinds of personal information used and the kinds of decisions involved (OAIC chapter 1, para 1.35; final guidance 30 September 2026, summarised by Allens). In a Hunter system that usually means automated triage, approval rules or AI scoring, so our specification marks each one.

Software testing and go-live on Newcastle time

Our hours and the 1.5-hour afternoon overlap are set out on the Newcastle page. Taking over another developer’s system, or moving off Access, Excel or FileMaker

LittleMan advertises software rescue and Dev House answers a takeover FAQ, but neither lists the steps for a system whose developer has gone quiet.

  • Secure these before the old developer drifts away

    • Run a WHOIS lookup on your .com.au domain and check the registrant is your business, not the developer
    • Ask for the hosting account to be transferred to you, not closed, so the live system keeps running
    • Admin rights on the code repository, with its full commit history
    • A full database export plus uploaded files
    • A list of API keys and paid services, then rotate every key once you hold them
  • A written code review before any quote

    We read the code and database, then write down what can stay, what is fragile, which libraries are no longer supported, and whether repair or rebuild costs less. The quote rests on that document. If the review carries a fee, you see it and approve it before we start.

  • Moving off Access, Excel or FileMaker

    The target is a web app on Laravel or Next.js with PostgreSQL or MySQL. Fields are mapped, a test import runs on a copy and you check sample records; for FileMaker, layout screenshots become the first specification. Both systems stay live through one full payroll week or month-end, and the old one is switched off only once the totals agree.
