Offshore software development means paying a team in another country to build software that you then own. There are two very different ways to buy it, and many owners who search for Indian web developers or app developers want the second one: a finished website, online shop or app, launched and handed over.

Hiring a person (directly, through a staffing firm or through an employer of record) makes you the manager. You set the tasks, check the work and carry the risk if it stalls. A fixed-price project puts delivery on the vendor, measured against a written scope. The table compares the six options open to an Australian business.

When someone else is the better choice. What a developer really costs in Australia, against a fixed project price

An annual salary and a one-off project price aren't like-for-like, which is why the 'save 40–70%' claims on many offshore pages tell you little. A salary buys a person's time, busy or not; a project price buys a defined result with an end date.

SEEK's October 2026 figures put the typical software engineer in the ICT industry at A$128,060 and a web developer at A$90,000. Add the 12% superannuation guarantee and divide by 52, and the comparison looks like this.

Is it safe to outsource software development to India? Seven things to get in writing

Yes, if these seven points are in place before you pay. Use the list on any vendor, offshore or local, including us. If a vendor won't put a point in writing, treat that as the answer.

7 questions to ask

  1. A written, signed IP assignment. Under the Copyright Act 1968 s196(3), an assignment of copyright has no effect unless it's in writing and signed by the assignor. Under s35(6), an employer owns work its employees make in the course of their employment, but a contractor or agency isn't your employee, so it keeps copyright in your code by default.
  2. Code in a repository you own from day one. Domain, hosting, app-store and payment-gateway accounts in your name, with credentials handed over at each milestone. That works as practical escrow; a formal source-code escrow agreement is an option for large builds.
  3. Milestone payments tied to working demos. Pay against features you've tested on a staging URL, never 100% upfront.
  4. APP 8 terms if the Privacy Act covers you. Before an overseas team handles personal information, APP 8.1 requires reasonable steps to ensure it doesn't breach the APPs, which the OAIC generally expects to be an enforceable contract that also binds subcontractors. Under s16C you stay accountable for their breaches. Use test data where you can.
  5. Don't assume the small-business exemption applies. Most businesses with turnover of A$3 million or less aren't covered by the Privacy Act, but exceptions apply, including health service providers (the Act's definition also takes in disability services). That matters for allied health website design and NDIS website design.
  6. A data-breach notification clause. If you're covered, the Notifiable Data Breaches scheme expects you to assess a suspected breach within 30 days at most and notify eligible ones as soon as practicable. If your overseas developer suffers the breach, assessing it is still your job, so the vendor must tell you promptly.
  7. Acceptance criteria and a warranty period. Agree in writing what 'done' means for each milestone, and how long bugs found after launch are fixed at no charge.

From 10 December 2026, if the Privacy Act covers you, new APP 1.7–1.9 require your privacy policy to disclose when a computer program makes, or substantially contributes to, decisions that could significantly affect people, and what personal information it uses. That matters if your custom software scores leads or screens applications, as a CRM for education and migration agents might.

Outsourcing to India: what usually goes wrong and how to avoid it

The stories on Reddit about outsourcing to India tend to repeat the same six failures. Each one comes from how the job was set up, and each has a fix you can put in place before any money changes hands.

  • The vanishing freelancer

    A developer takes a deposit, delivers half a site, then stops replying. The code lived on their laptop and the hosting sat in their account, so you start again. The fix: code in your repository and accounts in your name from week one, so another developer can pick up where the last one stopped, and milestone payments, so only the current stage is at risk (checklist items 2 and 3).

  • Scope creep and the quote that balloons

    A low quote wins the job, then every request becomes a paid change. Usually nobody wrote down what was in scope. The fix: a written scope with acceptance criteria for each milestone, and a fixed price that covers everything on that list (checklist item 7).

  • ‘Yes’ meaning ‘I heard you’

    Across cultures and time zones, 'yes' can mean 'I understood the words', not 'it will be done by Friday'. The fix: confirm every decision in writing after the call, and judge progress on the staging demo, not on status updates (checklist items 3 and 7).

  • Code and accounts you can’t access

    The site works, but the domain, hosting, Apple developer account or payment gateway is in the vendor's name, so changing developers means negotiating for access to your own business. The fix: every account opened in your name, with you as owner and the vendor as a user you can remove (checklist item 2).

  • No documentation at handover

    The project ends with a login and nothing else: no list of plugins, no note on how to deploy, no record of where backups go. The fix: make a handover document part of the final milestone's acceptance criteria (checklist item 7).

  • A time-zone promise that wasn’t true

    A vendor promises full AEST overlap, then nobody answers until mid-afternoon your time. Check with simple arithmetic: our 10am–7pm IST day overlaps a Sydney 9–5 by 1.5 hours during daylight saving. The fix: get the vendor's hours in IST written into the scope (checklist item 7) and convert them with the hours table.

Six red flags that should end the conversation with any vendor:

How do I hire an Indian programmer from Australia?

Decide first what you're buying: a finished project or a person's time. Shortlist two or three vendors whose reviews you can check on Google, Upwork or Clutch, then test the best one with a small paid job, such as a landing page or a bug fix. Before the full build, sign a written scope with acceptance criteria and an IP assignment, keep the code and accounts in your name, and pay by milestone.

How much does it cost to hire a dedicated developer in India?

There is no single rate. Monthly fees depend on the vendor, the developer's seniority and the minimum term, and many staffing firms only quote on a call. Judge any quote against the local benchmark: a software engineer in Australia costs an employer about A$143,400 a year with super, roughly A$11,950 a month, before leave and on-costs. How long does it take to start a project with an Indian development team?

How do I pay an Indian development company, and do I pay GST?

Pay by stage against working software, never in full upfront; with us, the payment method, invoice currency and schedule are confirmed in writing for your business before you sign. Our invoices don't include Australian GST: Codingclave is an overseas (India-based) supplier and is not registered for Australian GST. If your business is GST-registered, check with your accountant whether the reverse charge applies. Per the ATO, it matters when a purchase isn't wholly for a creditable purpose; where it applies, GST is 10% of the price, reported on your BAS.

Who owns the code when an Indian company builds my software?

Until it's assigned to you in writing, the company that wrote it does. Under the Copyright Act 1968 s35(6), an employer owns work its employees make in the course of their employment, but an agency or contractor isn't your employee, so it keeps copyright by default. Under s196(3), an assignment has no effect unless it's in writing and signed by the assignor. Get a signed assignment covering code, designs and content, and keep the repository and accounts in your name.

Should I use a software development company in Australia or an offshore one?

Choose a local company if you need on-site workshops, calls throughout your business day or an Australian business as your contract counterparty, and expect to pay local rates for it. Choose an offshore team when the job has a clear scope, you want a fixed price and you can work with less shared time, briefing in your afternoon and reviewing progress the next morning. Either way, apply the same checklist: written IP assignment, accounts in your name and milestone payments.

Is India or the Philippines better for outsourcing from Australia?
